Rule 42
Provisions related to promotion complaint
: (1) Police personnel who are not satisfied with the promotion recommendation of the following promotion committee may file a complaint with the following promotion complaint hearing committee within seven days from the date of the decision regarding the promotion recommendation:-
(2) The committee hearing complaints about promotion shall make a complaint after receiving a complaint as per sub-rule (1). On the day after the expiry of the deadline, the feedback of the promotion committee and the documents related to the complaint should be sent in writing to the secretariat of the promotion committee. If written in such a manner, the secretariat of the concerned promotion committee shall send the documents related to the complaint with its opinion and response to the complaint hearing committee within three days.
(3) Complaints filed as per sub-rule (1) should be resolved within fifteen days from the date of expiry of the deadline for filing complaints. The promotion complaint hearing committee may send a notice in writing to set a period for disclosing such reason or basis, if any reason or basis is required to be disclosed while the promotion committee evaluates the grounds for promotion.
(4) The recommendation of the promotion committee will be implemented only after the complaint filed in accordance with this rule is resolved.
(5) The Public Service Commission shall perform the secretariat work of the committee hearing promotion complaints on the promotion recommendation of the promotion committee as per clause (a) and (b) of sub-rule (1) of rule 27, the promotion committee as per clause (c) of sub-rule (1) of rule 27 The secretariat of the committee hearing promotion complaints based on promotion recommendation will be done by the ministry and the secretariat work of the committee hearing promotion complaints based on the promotion recommendation of the promotion committee according to clauses (d), (e) and (f) of sub-rule (1) of rule 27 will be done by the police headquarters.
(6) The committee hearing the promotion complaint based on the recommendation of the promotion committee of the promotion committee shall send the promotion complaint to the promotion committee if it is found that the recommendation of the promotion committee needs to be revised based on the fact that a candidate has not obtained the marks required to be obtained according to this regulation or has obtained the marks that should not be obtained. The hearing committee should make a recommendation for appointment in writing.
(7) If the complaint filed under sub-rule (1) is found to be false, 2 marks will be deducted for the promotion after the complaint, if it is the first time complaint and 3 marks will be deducted if it is a second time complaint.
